一、采购项目内容
（略）作为主办单位，**市**高桥镇人民政府、**外高桥集团股份有限公司作为承办单位现举办“**之门”浦东片区三岔港楔形绿地景观规划设计国际方案征集活动。本次方案征集活动将公开邀请具有相关规划设计经验的设计机构前来申请应征，提交资格预审申请文件（以下简称“申请文件”）。通过资格预审选取3个应征人参加征集活动，并提交应征设计成果。

4.应征申请人的资格4. Eligib（略） and Qualifications of Applicants4.1应（略）（以下简称“申请人”）应为合法注册的法人实体或由合法注册的法人实体组成的项目联合体，且应具有与本项目的功能性质相类似的设计经验。
4.1 The Applicant shall be a legal entity that has been legally incorporated in accordance with laws or a project consort（略）composed of legal entities that have been legally incorporated in accor（略）with laws, and shall have design experience in a project with the similar functional na（略） of this Project.
4.2应征申请人应具有承担本征集项目风景园林设计和建筑设计的相应资质或资格。
4.2 Applicants shall have the corresponding eligibility or qualifications to undertake the landscape design and architectural de（略） of this solicitation.
（1）中华人民**国境内的设计机构应具有政府有关行政主管部门核发的：风景园（略）（建筑工程）设计甲级及以上资质；
（1）Design entities within the People's Republic of China should have the following qualification issued by the relevant government administrative department: a qualification certificate of Grade A for landscape engineering design or a qualification certificate of Grade A for architectural design (architectural engineering) or above;

（2）Design entities outside the People's Republic of China should have a practice license or bu（略）license for landscape design or architectural design in accorda（略） with the national or local administrative regulations.

After receiving the registration form, the Organizer of Solicitation will send the download password of the Prequalification Documents to the Applicants.

6.申请（略）6.Submission of Application Documents申请文件递交（略）（略）午12 时00分，申请人应在递交截止时间之前将申请文件递交至征集组织机构。主办单位/承办单位和征集组织机构将拒绝接收逾期送达的申请文件。
The deadline for submission of Application Documents is 12:00 noon on June 4, 2024. Applicants shall submit such documents to the Organizer of Solicitation before the deadline. The Sponsor/Organizers and the Organizer of Solicitation will reject any application documents that arrive after the specified deadline.
7.资格预审公告发布媒体7. Media Releasing Announcement on Prequalification本公告在中国招标投标公共服务平台（（略）com）、中国政府采购网（（略）gov.cn）、（略）网站（www.bkpmzb.com）同时发布。本公告的修改、补充以在以上网站发布的内容为准。
This announcement will be published on the China Tendering and Bidding Public Service Platform (（略）com), China Government Procurement Network (（略）gov.cn), and the website of Beijing Science Park Auction Tender Co., Ltd. (（略）com) at the same time. The amendment and supplement of the announcement shall be subject to the contents released via the websites aforementioned.
8.其它条款8.Miscellaneous8.1知识产权
8.1 Intellectual Property Rights (IPRs)
8.1.1本次方案（略）（包括A3版面设计文册、A0标准轻质展板、电子文件、模型和应征设计方案著作权声明等）均不退回。
8.1.1 All valid response proposals (in（略）the A3 sized design book, A0 standard lightweight exhibit（略）panel, electronic documents, mo（略）and the Copyright Statement of De（略） Proposals) received in this solicitation will not be returned.
8.1.2应征设计文件和设计成果的知识产权由主办单位/承办单位与应征人共同享有。
8.1.2 The IPRs of the De（略） Proposals and design results shall be commonly owned by the Sponsor/Organizers and the Participants.
8.1.3应征人对其应征设计文件享有署名权，在征（略）文件的相关内容。除应征人的设计标准、设计导则和绘图元素以外，应征人（略）。
8.1.3 Participants hold the right of authors（略）for their Design Proposals and can co（略）on and display such Design Proposals in the forms of media commu（略）trade magaz（略）publications among others after granted with the Sponsor’s/Organizers’ consent in writing. The Parti（略）shall not use the Design Proposals and design results on other design projects, except the Participants’ design standards, design guidelines, and dr（略） elements.
8.1.4应征人应保证提交的应征（略）括但不限于著作权、专利权）或专有技术或商业秘密。应征人应保证，如果其应征设计文件使用或包含任何其他人的知识产权或专有技术或商业秘密，应征人应已经（略）。应征人因侵犯他人知识产权（略）
8.1.4 Participants shall en（略）that all the submitted Design Proposals and design results have not infringed upon and will not infringe upon IPRs (including but not limited to copyright and patent right) or propr（略）technologies or trade secrets of others within or outside the People’s Re（略）of China. The Participants shall guarantee that if their Design Proposals use or include IPRs or proprietary technologies or trade secrets of ot（略）the Participants shall have already obtained legitimate, valid and suffi（略）authorization from the right holders. The Participants shall take all liabilities for any compensations arising from infringement upon IPRs or propr（略） technologies or trade secrets of others.
8.1.5主办单位/承办单位有权在本（略）主办单位/承办单位在项目的规划设计中或在规划设计方案调整综合时可以全部或部分使用应征（略）他项目。
8.1.5 The Sponsor/Organizers have the right to use the pl（略）and design results submitted by the Participants in the planning and de（略）of this Project. The Sponso（略）are allowed to use the Design Proposals in whole or in part in the pl（略）and de（略）of this Project or the adjustment and integration of the planning and design proposals, and have the right to modify them. The Spons（略） shall not use the Design Proposals and design results for a purpose other than this Project.
8.1.6主办单位/承办单位可以对所有应征设计文件及（略）计机构的名称。
8.1.6 The Sponsor（略）can pr（略）pu（略）and exhibit all the Design Proposals and de（略）results, or comment on, display and publicize the De（略）Proposals and design results via media communications, trade magazines, publications or by other means. The preco（略） is indication of the names of design entities for such design.
8.1.7应征建筑设计方案（如果有）的著作权（略），但景观小品及其建构筑物除外。
8.1.7 The co（略）of architectural design pr（略）(if any) shall belong to the Parti（略）except for landscape embell（略） and their structures.
8.2应征设计补偿金
8.2 Compensations for Designs Proposals
承办单位将向按征集文件的要求在规定的时间内提交了有效应征文件的应征人支付应征设计补偿金，金额为人民（略）（含税）。当应征人出现下列情况时，承办单位将不予支付补偿金：
The Organizers will pay compensations for design proposals in the amount of RMB 1.4 million (including tax) for any Participant that has submitted valid response documents within specified time frame as required per Solicitation Documents. The Organizers will not pay any compensation when Participants are under any of the following circumstances:
（1）应征人未按规定时间提交应征文件；
（1）Participants fail to submit their response proposals within the specified time;
（2）应征人提交的应征文件经专家委员会评审被认定为未对征集文件要求作出实质性响应；
（2）The response proposals submitted by Participants are judged, upon the expert review, as not substantially respo（略） to the requirements of the Solicitation Documents;
（3）应征人被取消应征资格。
（3）Participants are disqualified.
8.3奖项和奖金的设置

本次方案征集将评选出1个（略），奖金为（略）（含税），获奖的应征人需结合评审专家意见和主办单位/承办单位的要求对其应征设计方案进行一轮方案优化，并提交相应设计成果（不含模型动画）。
This sol（略）will select one winning design proposal, with a prize of RMB 600,000 (tax included). The winning Part（略） will be required to refine their design proposal based on the opinions of the review experts and the requirements of the Sponsor/Organizers, and submit the corresponding design results (excluding model animations).
8.4适用法律

The solicitation per se and any documents relating th（略）shall be governed only by the laws and regu（略） of the People’s Republic of China.
8.5语言
8.5 Languages
资格预审文件以及与资格预审文件相关的补充文件和澄清文件均使用中文和英文书写。申请文件应使用中文书写，申请人随申请文件提供的证明文件和印刷品可以使用另一种语言，但应（略）。在中文与其他语言的意思表达不一致时，以中文为准。
The language used in the Prequalification Documents and any supplement and clarification documents thereto shall be Chinese and English. Application Documents for Prequalification shall be drafted in Ch（略）. Another language can be used for the proof documents and printed materials that Applicants provide along with the Application Documents, but the version with Chinese translation shall be attached thereto. In the case of inconsistent expressions in both Chinese and another la（略） the Chinese version shall prevail.
